“HENDRICK'S GIN SWIRL YOUR SPRITZ” TERMS AND CONDITIONS

  1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. Entry is only open to Australian residents aged 18 years or over.
  3. Employees (and their immediate families) of the Promoter, Participating Venues (defined below) and agencies associated with this promotion are ineligible to participate. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  4. Entries into this promotion open on 01/11/2024 and close at 11:59pm AEDT on 31/01/2025 (“Promotional Period”).
  5. A participating venue is any venue nationally that stocks Hendrick’s Gin, serves Hendrick’s Gin Spritz drinks and displays advertising material featuring this promotion (each a “Participating Venue”).
  6. To be eligible enter, individuals must visit a Participating Venue and purchase a Hendrick’s Gin Spritz (“Eligible Purchase”) during the Promotional Period. Upon making an Eligible Purchase, individuals will be presented with a scratch card that once scratched, will reveal a promotional QR Code. In the event a scratch card is not automatically provided by a member of staff, it is the individual’s responsibility to request one.
  7. To enter, individuals must then, during the Promotional Period, complete the following steps:
    1. Scratch their scratch card to reveal the QR Code, scan the QR Code to visit the promotional website;
    2. Follow the prompts to enter their mobile number, then enter the (1) time verification code sent via text message (when prompted) to access the entry page;
    3. input the requested details (including their name, State/Territory of residence, date of birth and postcode);
    4. check the boxes agreeing to these Terms and Conditions and confirming that an Eligible Purchase was made; and then
    5. click the button to swirl your spritz and see if an instant win prize has been won.
  8. Upon submitting their entry, entrants will be notified instantly on screen, in writing, whether or not they have provisionally won an instant prize. All provisional instant winners are subject to verification. All valid entries received from winners and non-winners of an instant prize will be automatically placed in the Major Draw (defined below).
  9. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted person per day; and (b) each entry must be submitted separately and in accordance with entry requirements.
  10. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  11. Incomplete or indecipherable entries will be deemed invalid.
  12. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  13. The Promoter’s decision is final and no correspondence will be entered into.

    14. Instant Prizes

  14. 14. Instant win prizes will be awarded randomly throughout the Promotional Period. The instant prizes available to be won include:
    • Five thousand (5,000) x Hendrick’s Gin branded towels valued at $29.95 each.
  15. Upon verification, winners will be sent their prize. Winners will be asked to submit their residential address to receive their prize. Winners who fail to provide their residential address when requested, will forfeit their prize. ACT and SA winners of an instant prize will have their details (first initial, surname and postcode) published at https://hendricks-summer.promoconditions.com.au on 07/02/2025.

    16. Major Draw

  16. There will be one (1) draw conducted from all valid entries received (“Major Draw”). The Major Draw will take place at 3 Amy Close, Wyong NSW 2259 on 03/02/2025 at 11:00am AEDT, in the presence of an independent scrutineer. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. The winner will be notified in writing within two (2) business days of the Major Draw and their details (first initial, surname and postcode) will be published online at https://hendricks-summer.promoconditions.com.au on 07/02/2025. Prize must be claimed by 11:59pm AEDST on 06/03/2025.
  17. The first valid entry drawn in the Major Draw will win a holiday for two (2) adults (aged 18years or over) to Fiji valued at up to AUD$14,800 depending on date and point of departure. Prize is for two (2) adults and includes:
    • Two (2) return economy airfares between winners nearest Australian capital city and Nadi, Fiji;
    • Return private car transfers between the airport and accommodation in Denarau, Fiji;
    • Five (5) nights accommodation in a minimum four (4) star property (double share) in Denarau, Fiji;
    • A Hendrick’s Gin cocktail experience on board Cloud Nine for two (2) adults;
    • A Zipline and Jungle trek experience for two (2) adults;
    • Return boat transfers for two (2) people from winner’s accommodation in Denarau to the floating pontoon;
    • AU $500 spending money (winner only);
    • Comprehensive travel insurance for two (2) adults (subject to all travellers having no pre-existing medical conditions and being under 59 years of age); and
    • Full winner management: Includes all bookings, planning customised itinerary, flight monitoring and providing 24/7 phone support for the winner for the duration of their trip.

    18. Additional prize conditions:

    To claim the prize, the winner must respond to the winner notification and confirm that they meet the entry criteria outlined in these Terms & Conditions. Once the prize has been claimed, the winner and guest will be required to complete a further prize booking form including liability and publicity waiver within one month of the date that they successfully claimed the prize and were verified as the valid winner. The winner must finalise the prize booking within two (2) months of successfully claiming the prize and being verified as a valid winner, and the travel must be booked at least sixty (60) days prior to the intended travel departure date. All travel must be completed within twelve (12) months of the prize draw. Prize is a single event holiday and cannot be separated into different holiday vacations. Availability cannot be guaranteed during Christmas, school holiday and special event periods. The winner and their guest must meet all travel requirements and conditions of entry for all third-party suppliers (i.e Hotels, Airlines, Restaurants, Events, Activity suppliers etc). No compensation or alternative travel plans will be arranged should the prize winner and/ or their guest miss their outbound or return flights or fail to meet any check in requirements for any reason. These costs will be the responsibility and expense of the winner and travel partner. The winner must provide their bank account details (or account name and postal address for cheque) in order for the spending money portion of the prize to be awarded. Once booking is confirmed no changes are allowed, unless otherwise authorised by the Promoter in its absolute discretion and if permitted will incur a fee of $165 per person (including GST) plus supplier charges which is payable by the winner. Where the prize is cancelled due to unforeseen travel restrictions relating to COVID-19 (as determined by the applicable Local or Federal Government), the prize provider will use its best endeavours to reschedule to an alternative date (one revision only). The winner acknowledges that, in this instance, some elements of the trip may be non-refundable and therefore that element of the prize will be forfeited when re-booking.  Any further date changes permitted (as a result of Government determined COVID restrictions) will be determined by the Promoter in its absolute discretion.  Travel suppliers/airlines to be chosen at the discretion of Mavel Group (the Prizing Agency). Travel itinerary will be determined by the Promoter in its absolute discretion. Should the winner wish to extend their trip, permission must be sought from the Promoter who will decide in its absolute discretion. In the event the Promoter agrees for the winner to extend, all additional expenses to extend will be at the winner’s own expense, including any additional cost to extend their travel insurance policy by additional days, to ensure continuity of cover for the full duration of the trip. Comprehensive travel insurance is compulsory and included in the prize, subject to all travellers having no pre-existing medical conditions and being under 59 years of age. Unless expressly stated in these terms and conditions all other expenses become the responsibility of the winner and their guest including but not limited to all additional meals, additional spending money, incidentals, mini-bar, laundry, room service, telephone calls and all other ancillary costs. The winner and guest agree that they will not sell or otherwise provide their story and/or photographs to any media or other organisation apart from the Promoter or Prizing Agency. The winner and their guest are responsible for ensuring that they have valid passports (including 6 months validity from the date of scheduled return to Australia), and any requisite visas, vaccinations and travel documentation at their own expense. It is the sole responsibility of the winner to ensure their entry and the entry of their guest into the destination country, at their own expense, including ensuring all necessary passports, visas, travel authorisations, medical advice and recommended vaccinations and immunisations have been obtained prior to travel and, if required, on or by a date nominated by the Promoter. Failure to do so may result in a prize being forfeited. The Promoter makes no representation as to the safety of the destination and it is the responsibility of the winner and their companion (if any) to check the travel advice issued by the Department of Foreign Affairs and Trade at www.smartraveller.gov.au and assess the safety of the destination country prior to travel. The winner and their guest accept the conditions set by the Cloud-9 Zip and Dip Tour Provider (“Activities”) and acknowledge that any dangerous activities that may result in injury or death, and participate at their own risk. The winner and their guest accept that there may be weight and/or size limits. The Promoter and Activity organisers, in their absolute discretion, at all times reserve the right to: (a) prevent the winner or their guest from participating in the Activity if, at any time, they reasonably believe that the winner or their guest pose a safety risk or for any other reason; and/or (b) cancel the Activities if the conditions are deemed dangerous. If the Activities are varied for any reason beyond the control of the Promoter it may not be rescheduled and no compensation will be offered.

  18. The winner and their guest must depart from and return to the same departure point and travel together. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. The winner may be required to present their credit card at time of accommodation check in. The winner’s guest must be aged 18 years or over.
  19. The winner and their of their guest will each be required to fully complete a travel insurance application form provided by the Promoter, and may also be required to undergo medical tests as required by the Promoter’s nominated travel insurer, in order to redeem the travel insurance element of the prize. Any person found guilty of insurance fraud or failure to honestly and accurately disclose all relevant insurance information at the time of applying for a travel insurance policy or when making a claim forfeits any rights or entitlements to the travel insurance element of the prize. Travel insurance will be provided by the Promoter’s nominated travel insurer, and subject to approval by the travel insurer. In the event that the Promoter’s nominated travel insurer refuses to issue insurance to the winner and/or guest, the winner forfeits that travel insurance element of the prize. Travel insurance is subject to the terms and conditions issued by the Promoter’s nominated travel insurer, including but not limited to any limitations on the covered amount.
  20. As a condition of accepting the Major Draw prize, the winner (and their companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

    21. General

  21. A Participating Venue will not offer this promotion as an inducement directed at encouraging patrons to gamble in line with relevant state gambling authorities.
  22. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize (or part of the prize) at the time stipulated by the Promoter, then the prize (or that part of the prize) will be forfeited.
  23. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
  24. Total prize pool value is up to AUD$164,550.
  25. Prizes or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
  26. A draw for any instant win prizes that are won but are not claimed or the Major Draw prize if unclaimed, may take place on 07/03/2025 at 11:00am AEDT at the same place as the original Major Draw, subject to any directions from a regulatory authority. Winners if any, will be notified in writing within two (2) business days of the draw. The winner of the Major Draw prize (if needed) and any ACT/SA winners of an instant prize will have their details (first initial, surname and postcode) published online at https://hendricks-summer.promoconditions.com.au on 14/03/2025.
  27. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  28. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  29. In the event of war, terrorism, state of emergency, pandemic or any other kind of disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend, substitute or modify a prize, subject to any written directions from a relevant regulatory authority.
  30. A participating venue will not offer this promotion as an inducement directed at encouraging patrons to consume alcohol in line with relevant state liquor authorities.
  31. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
  32. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
  33. Quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured.
  34. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  35. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prizes.
  36. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.williamgrant.com/privacy-policy/. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose PI to any entity outside of Australia.
